Regular Meeting                                     November 10, 2009

The regular meeting of the Millcreek Township Board of Supervisors was called to order at 9:35 a.m. by Chairman Curtis in the Assembly Room of the Millcreek Township Municipal Building .  Present were Gerald Wolf, Brian McGrath , Lawrence Curtis , Joseph Kujawa , Evan Adair , Esq., Phyllis Vollbrecht, Richard Morris, P.E., and Chief Thomas Carlotti.

Following the Pledge to the Flag, Chairman Curtis called for public comment on agenda items other than development or rezoning applications.  No comments were received.

It was moved by Mr. Kujawa and seconded by Mr. McGrath to approve payment of the weekly bills in the following amounts:

            General Fund                                                                  $156,468.12
            General Fund                                                                  $735,687.82
            Pennsylvania State Fund                                                    $304,046.28
            Sewer Revenue Fund                                                        $  98,108.05

Motion carried by unanimous roll call vote.

On the recommendation of Engineer Morris, it was moved by Mr. McGrath and seconded by Mr. Kujawa to approve the reduction of National City Bank Letter of Credit SCL009245 from $109,792.00 to $87,356.00 for Sterling Ridge Subdivision, Section 1 (Maleno Developers, Inc.).  Items remaining to be completed include pavement, sidewalks, storm sewers and monumentation.  Motion carried by unanimous roll call vote.

On the recommendation of Engineer Morris, it was moved by Mr. McGrath and seconded by Mr. Kujawa to approve the reduction of National City Bank Letter of Credit SCL010756 from $71,901.00 to $52,346.00 for Sterling Ridge Subdivision, Section 2 (Maleno Developers, Inc.).  Items remaining to be completed include maintenance security on pavement, storm sewers and monumentation.  Motion carried by unanimous roll call vote.

On the recommendation of Engineer Morris, it was moved by Mr. McGrath and seconded by Mr. Kujawa to approve the reduction of National City Bank Letter of Credit SCL012407 from $56,272.00 to $19,159.00 for Sterling Ridge Subdivision, Section 3 (Maleno Developers, Inc.).  Items remaining to be completed include maintenance security on pavement and monumentation.  Motion carried by unanimous roll call vote.

On the recommendation of Engineer Morris, it was moved by Mr. McGrath and seconded by Mr. Kujawa to approve the reduction of National City Bank Letter of Credit SCL014532 from $91,933.00 to $14,848.00 for Sterling Ridge Subdivision, Section 4 (Maleno Developers, Inc.).  One item remaining to be completed is maintenance security on pavement.  Motion carried by unanimous roll call vote.

On the recommendation of Engineer Morris, it was moved by Mr. McGrath and seconded by Mr. Kujawa to approve the reduction of National City Bank Letter of Credit SCL011758 from $222,977.00 to $188,559.00 for Hidden Springs Subdivision (Maleno Developers, Inc.).  Items remaining to be completed include berming, maintenance security on pavement, sidewalks, storm sewers, monumentation, and signage.  In response to Mr. Kujawa’s question about the basins in the subdivision,  Engineer Morris said they are flood retention ponds which will always have water in them.  Motion carried by unanimous roll call vote.

It was recommended by Engineer Morris, moved by Mr. Kujawa and seconded by Mr. McGrath to approve a six-month extension of the subdivision approval for Ridgebury Apartments on West Ridge Road .  The developer is having difficulty in obtaining all the necessary permits.  Motion carried by unanimous roll call vote.

Mr. McGrath presented the Building Construction Report for October as follows:

It was moved by Mr. McGrath, seconded by Mr. Kujawa, and on the recommendation of Sewer Department Foreman Richard Bridger, that Jody Burton be permitted to attend a Simplified Water Analysis class on December 14, 2009 in Linesville, Pennsylvania and that he use a Township vehicle for transportation.  There being no public comment, the motion carried by unanimous roll call vote.

The following quotations were received for the removal of three dead trees on Schultz Road that are in danger of falling in the roadway:

            Lindenberger Tree Service                                                $675.00

It was moved by Mr. McGrath and seconded by Mr. Kujawa to award the contract to Dibble Tree Service for $325.00.  There being no public comment, the motion carried by unanimous roll call vote.

It was moved by Mr. Kujawa and seconded by Mr. McGrath to approve the purchase this year of one (1) 2011 model truck for the Streets Department through the State Piggyback Program and to be paid for in 2010.  The new emissions requirements on trucks beginning in 2010 will be between $7,000 and $9,000 more per truck.  Also, the company which puts on the dump bodies and plows has agreed to hold the 2009 price for their work.  There being no public comment, the motion carried by unanimous roll call vote.

It was recommended by Chief Carlotti, moved by Mr. Curtis and seconded by Mr. Kujawa that Cpl. Tony Chimera represent the Department at the annual AAA Community Traffic Awards program on November 12, 2009 in Cranberry, Pennsylvania and that he use a Township vehicle for transportation.  There being no public comment, the motion carried by unanimous roll call vote.

On the recommendation of Chief Carlotti, it was moved by Mr. Curtis and seconded by Mr. McGrath that Marianne Smith , Animal Enforcement Officer, be permitted to attend a PA Act 235 certification course at Bob’s Gun Shop, 8470 Edinboro Road , at the cost of $100.00.  This course is mandatory for Mrs. Smith to carry a firearm while on duty.  There being no public comment, the motion carried by unanimous roll call vote.

David Thiemann, 5840 Lake Pleasant Road , appeared as a Millcreek resident and as Chairman of the Millcreek Township Water Authority.  He thanked Mr. Curtis for his six years of service.  His dealings with Mr. Curtis through the Water Authority have always been positive.  The Water Authority and Mr. Curtis, representing the Townhip, have not always agreed but
Mr. Curtis consistently presented himself in a very professional manner and always listened to both sides of the discussion.  He wished Mr. Curtis the best in his future endeavors.

Gary Behr, 4045 Feidler Drive , thanked the management team the Township has had the last six years and Mr. Curtis for the great job he did.  He asked the Board to consider enhancing the Township’s website by hiring a professional service.  He also asked about pending minutes and Mr. Curtis said they will be posted as soon as approved.  Mr. Behr questioned whether a retired Township employee receiving a pension and then becomes re-employed would receive the pension as well as a salary for that position.  Treasurer Wolf said that person would absolutely receive the pension and a salary.  The pension does not change.  Mr. Behr was somewhat upset that the newly elected Supervisor will collect a pension with all associated benefits and a salary.  It was pointed out that the elected Auditors set the Supervisors’ salaries. 

Dan Laughlin, 4619 Autumnwood Trail, would like to see the Township run more like a business.  He suggested that the new Supervisor be paid the median income for Millcreek and when the standard of living goes up in Millcreek , so would his salary. 

There being no other citizens to be heard or further business to come before the Board, it was moved by Mr. Kujawa and seconded by Mr. McGrath to adjourn the meeting.  The motion carried and the meeting adjourned at 10:00 a.m.
