Regular Meeting
June
30, 2009
The
regular meeting of the Millcreek Township Board of Supervisors was called to
order at
9:34 a.m.
by Chairman Curtis in the Assembly Room of
the
Millcreek
Township
Municipal
Building
. Present
were Gerald Wolf,
Brian McGrath
,
Lawrence Curtis
,
Evan Adair
, Esq., Phyllis Vollbrecht, Richard Morris,
P.E., and Chief Thomas Carlotti. Because
of the heavy rains, Mr. Kujawa was working in the Township on weather-related
problems.
Following
the Pledge to the Flag, Chairman Curtis called for public comment on agenda
items other than development or rezoning applications.
No comments were received.
It
was moved by Mr. McGrath and seconded by Mr. Curtis to approve payment of the
weekly General Fund bills in the amount of $131,989.79 and the Performance and
Surety Bond Account Fund in the amount of $2,227.75.
Motion carried by unanimous roll call vote.
It was moved by Mr. McGrath and seconded by Mr. Curtis to approve Ordinance No.
2009-7; an Ordinance of the Township of Millcreek, Erie County, Pennsylvania
establishing pedestrian crosswalks; requiring where pedestrian crosswalks are
established that pedestrians cross streets only at such crosswalks and that
operators of motor vehicles yield the right of way to pedestrians in such
crosswalks; establishing a pedestrian crosswalk on Caughey Road north of the
school zone light pole north of West 38th Street; providing for placement and
erection of official signs to pedestrians and the traveling public of said
regulation; establishing fines and penalties for violations and including
severability and repeal or clauses and expressly repealing Ordinance No. 97-22
insofar as it established a crosswalk on Caughey Road at the point of the
pedestrian walkway from the parking lot on its east line.
Motion carried by unanimous roll call vote.
On
the recommendation of Engineer Morris, it was moved by Mr. McGrath and seconded
by Mr. Curtis to approve the reduction of PNC Bank Letter of Credit 18102242
from $239,990.00 to $97,416.00 for Millcreek Marketplace (Millcreek Marketplace,
LLC and Baldwin Bros., Inc., developers). Items
remaining to be completed include portions of storm water management facilities.
Motion carried by unanimous roll call vote.
Mr.
McGrath announced the retirement, after 40 years of service, of Streets
Department Head Foreman Clifford Joslin effective
June 30, 2009
. After
conducting interviews, it was moved by Mr. McGrath and seconded by Mr. Curtis to
promote Mark G. Dietz to Head Foreman of the Streets Department with an annual
salary of $62,000.00 and to promote Gary R. Walters to Assistant Head Foreman at
the rate of $27.64 per hour, both effective
July 1, 2009
. Chairman
Curtis called for public comment on the matter; none was received.
Motion carried by unanimous roll call vote.
It
was moved by Mr. McGrath and seconded by Mr. Curtis to retain the services of
Attorney
Evan Adair
to represent the Township in a case where
an appeal has been filed on the decision of the Board of Supervisors regarding
sidewalks. Chairman Curtis called
for public comment on the matter; none was received.
Motion carried by unanimous roll call vote.
Louis
Arcovio,
3927 Vista Drive
, appeared to ask the Board if a second
meeting was ever going to take place with Erie Water Works, the Millcreek
Township Water Authority, and the Supervisors.
Mr. Curtis indicated that several dates were given to him by the
Millcreek Water Authority and after checking with Mr. McGrath and Mr. Kujawa, he
will schedule that meeting today or tomorrow.
There
being no citizens to be heard or further business to come before the Board, it
was moved by Mr. McGrath, seconded by Mr. Curtis, to adjourn the meeting at
9:44 a.m.
