ORDINANCE NO, 64
Ordinance to prohibit the accumulation or deposit of snow
removed from private driveways or parking areas within the
limits of any street or road between the ditches thereof;
providing for notice to remove the obstruction thereby caused,
and providing for penalties.
WHEREAS, in the removal of snow from private driveways and parking areas, it has become common practice to leave the snow so removed, or a part of it, within the right of way of Township streets or roads I the. ditches thereof, Leaving ridges and uneven places in traffic lanes, thereby obstructing the safe flow of traffic and causing a condition dangerous to the traveling public.
BE IT ENACTED AND ORDAINED by
the Supervisors of Millcreek Township,
SECTION 1. That the accumulation or deposit of snow, removed from private driveways or parking areas, within the limits of any street or road between the ditches thereof is hereby prohibited.
SECTION 2. That any person who shall remove or cause or allow to be removed the accumulation of snow from any private driveway or parking area, and deposit or allow it to remain within the limits of any street or road between the ditches thereof shall, upon receipt of notice from the Township Supervisors so to do, forthwith remove the obstruction thereby created.
SECTION 3. That any person who shall neglect or refuse to remove such obstruction immediately upon receipt of notice either by registered mail or personal service from the Township Supervisors so to do shall upon summary conviction thereof before a Justice of the Peace in the Township of Millcreek be sentenced to pay a fine of not less than $2.00 nor more than $25.00 and costs of proceeding, which fine shall be paid to the Township Treasurer for the use of the Township, and in default of payment thereof shall be sentenced to undergo an imprisonment for not more than ten (10) days.
