ORDINANCE NO. 91-19
An ordinance to amend Millcreek
Township Ordinance No. 86-21 (regulating handicapped parking zones) by
increasing fines under Section 3 from $15.00 to $100.00, and including severability and repealor
clauses.
WHEREAS, it is proper and lawful for Millcreek Township, under the Motor Vehicle Code and the Second Class Township Code, to regulate parking and to provide parking for handicapped persons in Millcreek Township (see 75 Pa. C.S.A. 3354; 53 PS 65724; 75 Pa. C.S.A. 6109; 75 Pa. C.S.A. 6113).
BE IT ENACTED by the Board of Supervisors of Millcreek Township, Erie County, Pennsylvania, that Millcreek Township Ordinance No. 86-21 is hereby amended as follows:
SECTION 1. That Ordinance 86-21 be amended by deleting the existing Section 3of said ordinance and in lieu thereof enacting the following:
“SECTION 3. Any person charged with violating Section 1 of this ordinance shall, upon summary conviction before a District Justice, be sentenced to pay a fine of One Hundred ($100.00) Dollars and costs of prosecution, and in default of payment thereof, shall undergo imprisonment as the law provides.”
SECTION 2. If any section, sub-section, sentence, clause, phrase, or portion of its application to any person or circumstances if for any reason is held invalid or unconstitutional by any court, such holdings shall not be construed to affect the validity of any of the remaining provisions. It is hereby declared that the legislative intent that this Ordinance would have been adopted had such invalid or unconstitutional provision of its application not been included herein.
SECTION 3. All ordinances or parts of any ordinance inconsistent herewith are hereby repealed.
