Upon motion by Mr. Arthur F. Detisch , seconded by Mr. George S. Pulakos , the following Ordinance was duly enacted, 3 voting in favor of enactment, 0 voting against enactment.
ORDINANCE NO. 86-19
An Ordinance to amend Ordinance No.
73-16 (Ordinance No. 73-16 authorized the establishment of fire lanes at public
buildings, shopping plazas and other places of business or assembly and
provided penalties for violations of the Ordinance) by increasing the minimum
fine to $5.00 for violations of Ordinance 73-16 as amended by Ordinance 73-10.
WHEREAS, to promote and secure the safety of persons and property and to facilitate the fighting of fires and the evacuating of sick or injured persons in areas of pedestrian or automobile congestion, the Board of Supervisors deem it necessary that certain areas be designated as fire lanes and/or fire access areas; wherein the parking or standing of motor vehicles is prohibited.
WHEREAS, the Board of Supervisors deem it necessary that the minimum fine for violations of the fire lane ordinance be increased.
BE IT ENACTED by the Board
of Supervisors of Millcreek Township,
Section 1. Section 4 of Ordinance 73-16 is hereby deleted in its entirety and the following Section 4 is inserted in place of the deleted Section, to-wit:
“SECTION 4. That any person who shall violate any of the provisions shall, upon summary conviction thereof, before a Justice of the Peace, be sentenced to pay a fine of not less than Five ($5.00) Dollars and not more than Fifteen ($15.00) Dollars and costs of prosecution and, in default of payment thereof, shall undergo imprisonment for a term not to exceed five (5) days.”
Section 2. All Ordinances, or parts of Ordinances, inconsistent herewith, are hereby repealed.
