Upon motion by     Mr. Arthur F. Detisch    , seconded by     Mr. Paul J. Martin    , the following ordinance was duly enacted,   3   voting in favor of enactment,   0   voting against enactment.

 

ORDINANCE NO.    83-5

 

An Ordinance to amend Millcreek Township Ordinances 76-4, 73-16 and 71-1 and all other Millcreek Township Ordinances regulating, restricting, prohibiting or otherwise limiting the parking of vehicles in certain public and private property in Millcreek Township by providing that the minimum fine for violating such ordinances shall be increased by an additional Two ($2.00) Dollars in the event the parking ticket issued for parking violations remain unpaid for a period in excess of seventy-two (72) hours from the date of the issuance of the parking ticket by the Millcreek Township Police Department and further or additional notice of violation is mailed to the owner or operator in violation of the aforesaid parking ordinances; providing for notice on the ticket of the additional fine; repealing inconsistent ordinances.

 

WHEREAS, parking offenders frequently fail to respond to tickets placed on vehicles parked in violation of Millcreek Township Ordinances; and

 

WHEREAS, it is necessary to give further notice of the parking violation by mailing an additional notice of the violation to owners or operators; and

 

WHEREAS, Millcreek Township incurs substantial additional cost in mailing additional notices of violation.

 

THEREFORE, BE IT RESOLVED AND ORDAINED by the Supervisors of Millcreek Township, Erie County, Pennsylvania, and it is hereby enacted and ordained by the authority of same as follows:

 


SECTION 1.   That Millcreek Township Ordinances 76-4, 73-16, 71-1 and all other Millcreek Township Ordinances regulating, restricting, prohibiting or otherwise limiting parking of vehicles in designated public and private property in Millcreek Township be amended by providing that the fine for violating such ordinances shall be increased by an additional Two ($2.00) Dollars in the event the original parking ticket issued for the parking violation remains unpaid for a period in excess of seventy-two (72) hours from the date and time the ticket was originally issued by the Millcreek Township Police Department and a further or additional notice of violation is mailed to the owner or operator in violation of the aforesaid parking ordinances.

 

SECTION 2.   That appropriate warning of the increased fine or cost authorized by Section 1 of this Ordinance be printed on tickets being issued for parking violations.

 

SECTION 3.   All Ordinances or parts of Ordinances in conflict herewith are repealed.
