Land Use and
Development Regulations
Regulations governing how properties may be used and a developed are found in the Zoning Ordinance (No. 74-29, as amended) and the Subdivision and Land Development Ordinance (now Ordinance No. 2006-9). These are lengthy ordinances. The Subdivision and Land Development Ordinance was amended and restated in July 2006 and the Zoning Ordinance is in the process of being substantially restated. The Stormwater Management Ordinance (No. 97-4, amended and restated by No. 2003-5), establishes requirements for managing stormwater in developments.
Other ordinances establish regulations that affect use and development of property. These other ordinances include:
The Address Ordinance (No. 98-17), which establishes a process for numbering of properties and requires that all owners affix and maintain on their properties the assigned address.
Use Performance Standards (No. 99-17), an amendment to the Zoning Ordinance, which among other things established regulations requiring the enclosure of outside refuse collection areas, standards for exterior lighting and certain requirements for business and industrial uses, including planting strips along streets.
The Open Burning Ordinance (No. 2000-1, amended by No. 2001-14), which prohibits outside burning on most properties in Millcreek and prohibits generally the burning of leaf waste which State law requires be recycled.
The Sidewalk Ordinance (No. 2002-15), which confirms the requirement that sidewalks be constructed and maintained by owners of abutting properties and includes regulations that apply when sidewalks are not constructed as a required improvement in a subdivision or land development.
The Public & Private Improvements Code (No. 2003-3), which establishes general standards for the construction of improvements, both those to be dedicated to and then maintained by the Township and those to be owned and maintained privately.
The Uniform Construction Code Ordinance (No. 2004-9), which implemented and provides for administration and enforcement of the State's Uniform Construction Code. Because of this Ordinance, Ordinance No. 2004-10 amended the process for first obtaining a zoning permit prior to applying for a UCC permit.
