The regular meeting of the Millcreek Township Board of Supervisors was called to order at 9:35 a.m. by Chairman McGrath in the Assembly Room of the Millcreek Township Municipal Building.  Present were Gerald Wolf, Lawrence Curtis, Brian McGrath, Joseph Kujawa, Evan Adair, Esq., Phyllis Vollbrecht, Richard Morris, P.E., and Chief Richard Andrews.

 

Following the Pledge to the Flag, Chairman McGrath called for public comment on agenda items other than development or rezoning applications.  No comments were received.

 

It was moved by Mr. Curtis and seconded by Mr. Kujawa to approve the minutes of the Board’s April 8, 2008 meeting.  Motion carried by unanimous roll call vote.

 

It was moved by Mr. Kujawa and seconded by Mr. Curtis to approve payment of the weekly bills in the following amounts and with the exception of the Sewer Revenue Fund bills dated April 10, 2008:

 

            General Fund  (April 9, 2008)                                             $434,590.11

            General Fund  (April 14, 2008)                                           $  50,852.04

            Sewer Revenue Fund  (April 9, 2008)                                   $213,768.55

 

Motion carried by unanimous roll call vote.

 

A public hearing was held on the following subdivision and land development plans:

 

Linda and Bert Green.  Subdivision Plan.  A subdivision plan to create an 8,400 square foot parcel (Lot 1) and a 9,100 square foot parcel (Lot 2) located along the west line of
Cole Drive south of Helen Street in Tract 282.

 

Engineer Morris reported that the Millcreek Township Planning Commission recommended approval of the plan.  Mike Sanford, Sanford Surveying & Engineering, 2209 West Grandview Boulevard, appeared on behalf of the plan.  It was moved by Mr. Kujawa and seconded by Mr. Curtis to approve the subdivision plan.  Motion carried by unanimous roll call vote.

 

Fuhrman’s Cider Mill and Bakery.  Land Development Plan.  A land development plan to construct a 6,000 square foot retail/bakery with associated parking area located along the north line of East Gore Road opposite Cider Mill Road in Tract 339 and the South Gore Tract.

 

Engineer Morris reported that the Millcreek Township Planning Commission recommended approval with a request of $10,000.00 for a traffic signal upgrade at East Gore Road and Lake Pleasant Road.

 

Bill Gunther, 9470 West Law Road, North East, appeared on behalf of the plan.  He stated that because it is so early in the project, they are unsure of the commitment of the $10,000.00.  Mr. Kujawa said that if  within ten years traffic signal/improvements are warranted at the above intersection, the Township will request that contribution. 

 

It was moved by Mr. Kujawa and seconded by Mr. Curtis to approve the Land Development Plan with the request if warranted within ten years.  Motion carried by unanimous roll call vote.

 

Marquette Savings Bank.  Land Development Plan.  A land development plan to construct a 3,800 square foot bank with associated parking area located on the southeast corner of the intersection of Sterrettania Road (S.R. 0832) and West 38th Street (S.R. 4016) in Tract 82.

 

Engineer Morris reported that the Millcreek Township Planning Commission recommended approval with the following:

 

Condition

1.                   Receipt of Highway Occupancy Permit prior to Supervisors’ meeting.

 

Request

1.                   Two (2) $10,000.00 contributions for traffic signals; one (1) at
West 38th Street and Lancaster Road, and one (1) at Sterrettania Road and Love Road.

 

Engineer Morris said the HOP has not been received.  The Board feels that if an HOP is not in the Engineering Office before the Planning Commission meeting, it should not be heard, according to Mr. Kujawa.  It was moved by Mr. Curtis and seconded by Mr. Kujawa to table consideration of the Land Development Plan until the meeting of April 29, 2008.  Motion carried by unanimous roll call vote.

 

Mr. McGrath announced the following bids received and opened by the Erie County Council of Governments on March 27, 2008:

It was recommended by Engineer Morris, moved by Mr. Curtis and seconded by Mr. Kujawa to approve a six-month extension of the Land Development Plan approval for Millcreek Marketplace, Amendment 1, to November 22, 2008.  Motion carried by unanimous roll call vote.

 

It was moved by Mr. Kujawa and seconded by Mr. Curtis to approve Towing Agreements with D’Amico Towing, Eddie’s Collectibles, Romesburg Service, and West Lake Service.  Motion carried by unanimous roll call vote.

It was moved by Mr. Curtis and seconded by Mr. Kujawa to approve the above summer employees at the appropriate rates.  Chairman McGrath called for public comment on the matter; none was received.  Motion carried by unanimous roll call vote.

 

It was moved by Mr. Kujawa and seconded by Mr. Curtis that Christine Walter be permitted to travel to various businesses within the Township with Michelle Nestor (technical assistant helpng the Township with commercial recycling) on April 22 and 23, 2008 and that they be permitted to use a Township vehicle.  Chairman McGrath called for public comment on the matter; none was received.  Motion carried by unanimous roll call vote.

 

It was moved by Mr. Kujawa and seconded by Mr. Curtis that Christine Walter be permitted to attend a PNC Bank “Think Green Day” on April 25, 2008 at Wegmans, West Ridge Road from 9:00 a.m. to 2:000 p.m.  Chairman McGrath called for public comment on the matter; none was received.  Motion carried by unanimous roll call vote.

 

Mr. Kujawa announced a combined tire recycling collection day on May 3, 2008 from 9:00 a.m. to 4:00 p.m. at the Municipal Parking Annex at 1926 Holland Street.  A photo ID is required.  They will accept up to six car or light truck tires not on rims.

 

Attorney Adair reported that the Township received a request from the Erie County Tax Claim Bureau to approve or deny the sale from the Bureau’s repository list of a 25-foot wide parcel on Arlington Road.  This 25-foot wide parcel could not be developed and the entire width of the parcel is taken up by a storm drainage easement in favor of the Township.  Most of the parcel is subject to a 75-wide Penelec easement.  This parcels falls into the Category II parcel per the recent agreement the Board approved as to properties in tax sales.  It was recommended by Attorney Adair, moved by Mr. Curtis and seconded by Mr. Kujawa to deny the sale and to notify the Erie County Tax Claim Bureau that this parcel is a Category II parcel and should not be exposed to a tax sale.  Chairman McGrath called for public comment on the matter; none was received.  Motion carried by unanimous roll call vote.

 

There being no citizens to be heard or further business to come before the Board, it was moved by Mr. Kujawa and seconded by Mr. Curtis to adjourn the meeting.  The motion carried and the meeting adjourned at 10:06 a.m.
